SCOPE OF OUR SUPPORT

What We Can Help With. Where Professional Boundaries Apply.

Different debt, court and business financial matters can involve different regulatory and professional requirements. The support Stop Your Debt UK can provide will therefore depend upon the nature of the activity involved.

Nothing on this website should be interpreted as representing Stop Your Debt UK as authorised to undertake an activity for which regulatory authorisation, professional qualification or court permission is required where we do not hold that authorisation, qualification or permission.

01 CONSUMER CREDIT & DEBT ADVICE

FCA-Regulated Activities

Stop Your Debt UK is not an FCA-authorised debt advice firm and does not hold itself out as providing regulated debt counselling, debt adjusting or other regulated consumer-credit activities where FCA authorisation is required.

We may provide general information about debt terminology, processes and the types of routes that can exist, and may assist with permitted administrative and document-related matters. Providing general information is not intended to amount to a personal recommendation about which regulated debt solution a particular individual should enter.

Where a person's circumstances require regulated debt counselling, debt adjusting or another regulated consumer-credit activity, the relevant work must be undertaken through an appropriately FCA-authorised provider or another person lawfully entitled to undertake that activity.

Stop Your Debt UK may assist with the administrative coordination of a matter before, during or after a referral, where permitted, but the regulated advice and any regulated recommendation remain the responsibility of the appropriately authorised provider.

GENERAL INFORMATION & PERMITTED ADMINISTRATION does not replace regulated debt advice
02 LEGAL SERVICES

Legal Advice, Representation & Reserved Work

Stop Your Debt UK is not a firm of solicitors or barristers and is not authorised or regulated by the Solicitors Regulation Authority as a law firm.

We may provide general legal information and practical administrative assistance where lawful to do so. However, general information about a legal process should not be treated as a substitute for legal advice from an appropriately qualified professional who has considered the particular facts and circumstances of a matter.

Where a matter requires a reserved legal activity, formal legal representation, specialist legal advice or other work requiring professional authorisation, that work must be undertaken by an appropriately authorised or qualified legal professional.

Any solicitor, barrister or other legal professional introduced or engaged in connection with a matter is responsible for the legal services they personally provide and for explaining the terms, scope, regulatory protections and costs applicable to their own engagement.

GENERAL LEGAL INFORMATION is not a substitute for individual legal advice
03 COURT PROCEEDINGS

McKenzie Friend & Court Support

Where assistance is provided in connection with court proceedings on a McKenzie Friend basis, the client remains the litigant in person and remains responsible for the conduct of their own case.

A McKenzie Friend may, subject to the court's control, provide reasonable assistance such as moral support, taking notes, assisting with case papers and quietly providing assistance to the litigant.

A McKenzie Friend does not automatically have a right of audience and does not automatically have the right to conduct litigation. This means a McKenzie Friend cannot simply assume the role of a solicitor or barrister, address the court, conduct advocacy, sign court documents on behalf of the litigant or take over the conduct of proceedings.

Any permission for a lay person to exercise rights of audience or conduct litigation is a matter for the court and must not be assumed. The court also retains control over the assistance permitted in individual proceedings.

THE CLIENT REMAINS THE LITIGANT court permission and applicable rules remain decisive
04 BUSINESS & PERSONAL INSOLVENCY

Formal Insolvency Work

Stop Your Debt UK is not an insolvency practitioner and does not act as liquidator, administrator, nominee, supervisor, trustee in bankruptcy or in any other formal insolvency office-holder capacity.

We may provide general information about business financial difficulty and insolvency terminology and may assist with information gathering, documents, permitted administration and case coordination.

Where formal insolvency work or the appointment of an insolvency practitioner is required, the relevant work must be undertaken by an appropriately licensed insolvency practitioner.

The insolvency practitioner is independently responsible for their professional advice, statutory duties, decisions, appointments and conduct. Stop Your Debt UK does not control the exercise of an insolvency practitioner's statutory or professional functions.

FORMAL INSOLVENCY APPOINTMENTS are undertaken by licensed insolvency practitioners
05 DEBT RESPITE SCHEME

Breathing Space

Stop Your Debt UK does not itself start or administer a Breathing Space unless acting through a route lawfully entitled to do so.

Under the Debt Respite Scheme in England and Wales, a Breathing Space can only be started by a debt advice provider authorised by the Financial Conduct Authority to offer debt counselling, or by a local authority where it provides debt advice to residents.

Where a client may wish to explore Breathing Space, Stop Your Debt UK may provide general information about the scheme and help coordinate access to an appropriate authorised debt advice provider where required.

Eligibility, suitability, the inclusion of particular debts and the commencement or continuation of a Breathing Space are not determined by Stop Your Debt UK where those decisions fall to the authorised debt advice provider or other relevant authority.

BREATHING SPACE requires the appropriate authorised debt-advice route
06 CREDITORS, CCJs & GUARANTEES

Documents, Disputes & Liability

Information supplied by Stop Your Debt UK about creditor correspondence, County Court Judgments, enforcement, personal guarantees or other legal documents is general information unless expressly provided by an appropriately authorised or qualified professional under a separate professional engagement.

Whether a debt is legally enforceable, whether a personal guarantee is valid or enforceable, whether a court judgment can be challenged or set aside, and what procedural or legal response should be made can depend upon the individual facts, documents, evidence and applicable law.

Stop Your Debt UK may help organise relevant documents, correspondence and factual information and may assist with permitted administration and case coordination. Where legal advice, regulated debt advice or specialist representation is required, the matter should be referred or introduced to the appropriate professional.

Nothing published on the Stop Your Debt UK website, within a guide, through LetterChekr™, in general correspondence or in other educational material should be treated as a guarantee that a debt, judgment, guarantee or enforcement action can be removed, cancelled, reduced, avoided or successfully challenged.

OUTCOMES DEPEND ON THE INDIVIDUAL CIRCUMSTANCES no particular legal or financial outcome is guaranteed
NO GUARANTEED OUTCOMES

Every matter depends on its own circumstances.

Stop Your Debt UK does not guarantee that a creditor will accept a proposal, stop contact, discontinue proceedings, agree to a settlement, consent to an application, refrain from enforcement or take any other particular course of action.

We do not guarantee that a court will make a particular order, that a judgment will be set aside or removed, that a personal guarantee will be found unenforceable, that an insolvency process will produce a particular result or that any debt will be reduced, written off or otherwise resolved on particular terms.

Outcomes may depend upon creditors, courts, regulators, insolvency practitioners, legal professionals, authorised debt advisers and other third parties whose decisions and professional responsibilities are outside the control of Stop Your Debt UK.

THIRD-PARTY PROFESSIONALS

A referral or introduction does not make that professional part of Stop Your Debt UK.

Where Stop Your Debt UK introduces or refers a client to an FCA-authorised provider, solicitor, barrister, licensed insolvency practitioner or another independent professional, that professional may provide services under their own terms of engagement and regulatory framework.

Unless expressly stated otherwise in writing, those professionals are independent of Stop Your Debt UK and remain responsible for their own advice, professional conduct, regulatory obligations, fees and services.

YOUR INFORMATION MATTERS

Our support depends upon accurate and complete information.

Clients are responsible for providing accurate, complete and up-to-date information and for promptly supplying relevant correspondence, documents, deadlines and changes in circumstances.

Missing, inaccurate, incomplete or late information may affect the assistance that can be provided and may also affect the ability of any professional involved to properly assess or progress a matter.
